Amir’s counsel terms judgement as historical

Srinagar, May 27 (ANH): The High Court on Friday directed the Jammu and Kashmir (J&K) government to exhume the body of Ramban youth, Mohammad Amir Magray, who was killed in Hyderpora encounter on November 15, 2021.

In the encounter, three more persons including the building owner Altaf Ahmad Bhat and Dr Mudasir Gul of whom Magray was an employee were killed.

Allowing the petition filed by Amir’s father, Mohammad Latief Magray, a bench of Sanjeev Kumar while pronouncing the verdict asked the government to make proper arrangement for the transportion of Amir’s body to his native village in Jammu’s Ramban district. 

However, the court gave free hand to government to impose reasonable terms and conditions in respect of transportation, burial and exhumation.

“Incase the body is highly putrefied and is not in a  deliverable state or is likely to pose risk to public health and hygiene, the state shall pay to the petitioner a compensation of Rs.5 lakhs for deprivation of his right to have the dead body of his son and give him decent burial as per family traditions, religious obligations and faith which the deceased professed when he was alive,” reads the judgement.

Mohammad Latief Magray had filed the petition through his counsel Deepika Singh Rajawat in December last year. 

The court had reserved the verdict on May 19 after hearing the parties. 

Terming the verdict as historic, Deepika Singh Rajawat while talking to The Asian News Hub (ANH) said that parents of Amir have at last got justice.

“This verdict proves that judiciary is not under any compulsion. Such type of judgements boost the morale of people,” she added.
