A Special NIA Court in Budgam on Tuesday has ordered the attachment of immovable property belonging to absconding accused Dr Ghulam Nabi Shah alias Dr Fai in connection with a UAPA case registered at Police Station Budgam.
The order was passed by the Court of the Special Judge (NIA), Budgam, after the accused failed to appear before the investigating agency despite the issuance of a proclamation. The court had earlier declared Dr Fai a proclaimed absconder on April 26, 2025, in FIR No. 46/2020 under Sections 10, 13 and 39 of the Unlawful Activities (Prevention) Act.
The prosecution moved an application under Section 83 of the CrPC (now Section 85 of BNSS), stating that the accused had deliberately evaded the legal process and concealed himself to avoid arrest. The court observed that despite being given sufficient opportunity to appear, the accused chose not to comply, compelling the authorities to seek attachment of his property.

As per revenue records placed before the court, the accused owns 01 Kanal and 02 Marlas of land at Village Wadwan, Budgam, and 11 Marlas of land at Village Chattabugh, Budgam.
The court noted that the properties were presently in possession of the accused’s brothers and that there was a strong possibility of alienation, which could frustrate the ongoing legal proceedings.
Accordingly, the court directed the District Collector Budgam to attach the properties and take possession forthwith, with the assistance of revenue authorities for identification and demarcation. The SSP Budgam has also been instructed to provide necessary police support during the process.
Syed Ghulam Nabi Fai is a Kashmiri-origin individual based in the United States and has previously been identified in public records as the founder of the Kashmiri American Council. In 2011, US authorities had stated that the organisation functioned as a front for Pakistan’s Inter-Services Intelligence (ISI).
