Kupwara court grants bail to DySP, 7 cops in custodial torture case

A deputy superintendent of police (DySP) and five other cops have been granted bail in a case linked to the custodial torture of a fellow police constable.

According to the bail order, DySP Aijaz Ahmad Naik, other cops including Riyaz Ahmad Mir, Jahangeer Ahmad Beigh, Mohd Younis Khan, Shakir Hussain Khoja, Tanveer Ahmad Malla, Altaf Hussain Bhat and Shahnawaz Ahmad Deedad, who are lodged in Srinagar jail, have been granted bail by the Kupwara court.

The court has directed the accused to furnish bail and surety bonds of Rs 1 lakh each and none of the accused shall leave the territorial jurisdiction of the court without prior permission.

It has also asked the accused to deposit their passports in the court, directing them to not try to intimidate, hamper or temper with the prosecution evidence, nor shall they threaten any prosecution witness to hamper the trial.

They have been asked to remain present before the trial court on each and every date of hearing unless exempted. “Any breach of the conditions shall be viewed seriously and shall warrant cancellation of bail and the like wise bail bonds Rs 1 lakh with one surety has been attested and accepted today,” the court said.

The court has directed and authorised the jail authorities to release the accused after they furnish bail bonds, and that they are not involved or required in any other offences or case.

The accused had been arrested over custodial torture of their colleague Khurshid Ahmad Chohan in February 2023. The Central Bureau of Investigation (CBI) had registered a case on July 26 on various counts, including the attempt to murder following a probe into the custodial torture.

Earlier, on July 21, the Supreme Court had directed the CBI to register a case against the accused officials, while awarding Rs 50 lakh compensation to the victim. (KNO)
